Employers' Access to Workers' Information

If the employer is participating in the appeal, they have the right to receive all relevant case material. They are required to sign an Undertaking of Confidentiality. This means that they understand the information we send them is to be used for workplace and safety purposes only.

Before we release Case Materials to the employer, we’ll ask the worker to consent to the release of their information.

Getting the Worker’s Consent

We’ll send the case materials to the worker and their representative. We’ll ask the worker to complete a Consent Form to Release a Worker’s Information. Workers have 4 weeks to complete the consent form and send it to us.

Workers may consent to the release of all or part of the information in the case materials.

If the worker consents or doesn’t return the consent form, we’ll release the case materials to the participating employer and their representative.

If the Worker Doesn’t Consent

If a worker does not agree to release the case materials, we’ll contact the parties to see if their objection can be resolved through mediation. If not, we’ll ask both the worker and employer to send us written submissions about why the information should or shouldn’t be released. A Vice-Chair will make a decision on the release of information.
