The worker appealed a decision of the Appeals Resolution Officer denying entitlement for an injury resulting from an insect bite.
Board Operational Policy Manual, Document No. 15-03-03, on weather conditions, allows entitlement for injury resulting from insect bites.The worker claimed that he was bitten by an insect while sitting just outside the body shop where he worked, having lunch. The Vice-Chair found that the worker was engaged in activity that was reasonably incidental to employment. There were no witnesses but the Vice-Chair found that the worker was bitten by an insect, resulting in an MRSA infection. The appeal was allowed.
