The worker appealed a decision of the Appeals Resolution Officer denying entitlement for traumatic mental stress.
The events on which the worker based his claim were employment decisions, which are excluded from entitlement for mental stress. One of the events involved a situation where a union representative honestly, but mistakenly, believed that the worker had threatened suicide. This led to an investigation, including calling the police. The Panel found that calling the police was part of the employer's investigation of the allegations and that it fell within the scope of an employment function. The employer had an obligation to investigate and call the police in response to what was perceived as a credible threat.The appeal was dismissed.
