The worker's application for reconsideration of Decision No. 128/15 was denied. The worker submitted that the hearing panel erred in failing to apply the new Board policy on pre-existing conditions. However, the Vice-Chair noted that the Tribunal applies Board policy that was in effect at the time of the operating level decision.
