The issues under appeal was initial entitlement for a concussion and entitlement to health care benefits for eyeglasses and vision testing.
The Panel allowed the appeal.The Panel found that while the brain SPECT scan is not, in and of itself, evidence that the worker sustained a concussion, it was nevertheless consistent with the preponderance of other medical evidence that the worker sustained a concussion in the accident. In addition, given the chronicity of the worker's post-concussion symptoms from the date of accident to the current time, the Panel found that her condition was permanent. She had entitlement to a NEL assessment for post-concussion syndrome.Section 33 of the WSIA, provides that "a worker who sustains an injury is entitled to such health care as may be necessary, appropriate and sufficient as a result of the injury." Health care benefits are decided under Policy 17-01-02, "Entitlement to Health Care". The worker had entitlement for her vision impairment resulting from the concussion and health care benefits associated with that impairment, including prescribed eyeglasses and vision testing.
